Terms of Use

These Terms of Use ("Terms") govern your use of the MateSync mobile application and any related services we provide ("MateSync" or "the Service"). By using MateSync, you agree to these Terms. If you don't agree, please don't use the Service.

MateSync is operated in Australia and these Terms are governed by Australian law, including the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

1. Who can use MateSync

You must be at least 16 years old to use MateSync. If you're between 16 and 18, you confirm that a parent or guardian is aware of your use of the Service. You must provide accurate information when creating an account.

3. Acceptable use

You agree to use MateSync only for its intended purpose — coordinating roster information between you and your mates. You will not:

4. Your content

You retain ownership of any content you upload to MateSync (such as your profile picture, roster details, and display name). By uploading content, you grant us a limited licence to store, display, and process it solely to provide the Service to you and the mates you've connected with.

5. Subscriptions (MateSync Pro)

5.1 Free tier

MateSync's free tier is free forever and does not require payment information. It includes one roster, one connected mate, the timeline view, all shift types, push notifications, and standard FIFO presets.

5.2 Pro tier

MateSync Pro is an auto-renewing subscription offering additional features:

Both subscriptions include a 7-day free trial for new subscribers. You can cancel during the free trial without being charged.

5.3 Billing and renewal

Subscriptions are billed through your Apple ID and managed entirely by Apple under their standard subscription terms. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.

5.4 Cancelling your subscription

You can cancel your subscription at any time:

Cancellation takes effect at the end of your current billing period. You will continue to have Pro access until then.

5.5 Refunds

Refunds for subscriptions are handled by Apple under their refund policies. Request a refund via reportaproblem.apple.com. Nothing in these Terms limits your rights under the Australian Consumer Law, including guarantees that the Service is fit for purpose and matches descriptions.

5.6 Waitlist early-access

The first 100 sign-ups via our waitlist receive 6 months of MateSync Pro at no cost, automatically applied when they create an account using the email address they used on the waitlist. After this period, you may choose to subscribe to continue Pro access. No card details are required for the free access period.

6. Australian Consumer Law

Our Service comes with consumer guarantees under the Australian Consumer Law that cannot be excluded. These include guarantees that the Service will be:

If we fail to meet a consumer guarantee, you may be entitled to a remedy under the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or other right or remedy under Australian law that cannot be lawfully excluded.

7. Service availability

We work to keep MateSync running smoothly but the Service may occasionally be unavailable for maintenance, updates, or due to issues with third-party providers (Apple, our hosting partners). We don't guarantee uninterrupted service. Where the Service is unavailable for an extended period, we will work to restore it promptly.

8. Limitations on liability

To the maximum extent permitted by Australian law, MateSync's total liability to you for any loss or damage arising from these Terms or your use of the Service is limited to:

We are not liable for indirect, consequential, or special losses (including loss of profits, data, or goodwill). Nothing in this section limits your rights under the Australian Consumer Law.

9. Changes to MateSync

We may add, modify, or remove features as the Service evolves. We'll try to give reasonable notice of material changes. If a change materially reduces functionality of a paid subscription you've purchased, you may be entitled to a remedy under the Australian Consumer Law.

10. Changes to these Terms

We may update these Terms occasionally. Material changes will be communicated in-app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that puts others at risk. Where possible, we'll give you notice and an opportunity to fix the issue first, unless the breach is serious or repeated.

12. Governing law and disputes

These Terms are governed by the laws of South Australia, Australia. Disputes arising from or relating to your use of MateSync are subject to the exclusive jurisdiction of the courts of South Australia.
